PZC2014-6 To amend the Willington Zoning Regulation: ~(Section 11.08.04 to allow for a landscaped buffer or a fence along lots containing gasoline stations along boundaries abutting residential zones and ~Section 19.04.01 to allow for an increase in square footage of non-commercial signs ordered by a public official. ) Applicant: Willington Planning and Zoning Commission (Received February 18, 2014 Public Hearing March 18, 2014 Decision within 65 days after close of P.H.)

Vice - Chairman Roberts said they have 5 members present so they can vote on the regulation change.  A discussion was held on the proposed wording.  S. Yorgensen said they have elected not to go back to the Attorney for modifications since they drafted them. If a definition or anything else needs torqueing it can be done after July when there is money for the Attorney to edit.  

W. Parsell and J. Sullivan both listened to the minutes recorded from the Public Hearing and were comfortable on taking a vote.  

E. Standish motioned to amend the Willington Zoning Regulation: ~(Section 11.08.04 to allow for a landscaped buffer or a fence along lots containing gasoline stations along boundaries abutting residential zones and Section 19.04.01 to allow for an increase in square footage of non-commercial signs ordered by a public official) W. Parsell seconded the motion.  All in favor.  Motion carried.

E. Standish motioned to approve the minutes of 3/18/14.  W. Parsell seconded the motion.  All in favor.  Motion carried.  

Correspondence

  • Copy of a letter from WINCOG to Town of Ellington regarding a proposal for town-wide moratorium on palliative marijuana production facilities and dispensaries.
  • Letter from First Selectman Christina Mailhos to the PZC regarding an issue on Village Hill Road.
Staff Report/Discussion

S.Yorgensen said there is an issue on Village Hill and a discussion was held on the letter from Selectman Mailhos to the PZC; Selectman Mailhos said she is getting calls from a neighbor every day.  S. Yorgensen said is doing what she can to resolve the situation and added that they cannot spend any more on legal fees as they are well over budget.  J. Sullivan asked if could bill the party for the legal fees in court and S. Yorgensen said no, they can only ask for fines in court.  E.  Standish said he would like to respond to the Selectmen’s letter and let them know they are understaffed.  J. Sullivan said he would like to contact the Selectmen and ask for funding for this specific situation.  A discussion was held regarding this.

A discussion was held on the property and J. Sullivan asked how long the issue has been going on and S. Yorgensen said since the 90s.  

Selectman Mailhos arrived and said she sent a letter to the trustees to let them know something needed to be done. S. Yorgensen said she is further along on this issue than ever before and has spent a lot of time on it.  A discussion was held on the next step.  S. Yorgensen said they can go to court and asked for fines and penalties and hope it covers the legal fees; if the Town wins and they are awarded and not paid, a lien is put on the property.  

E. Standish said Planning and Zoning needs more manpower and unless the Board of Finance loosens some strings, their hands are tied. Further discussion was held on a course of action.
